Marriage Registration
 

As per Government notification, registration of marriage under the Hindu Marriage Act, 1955 read with West Bengal Hindu Marriage Registration Rules, 2010 and under the Special Marriage Act, 1954 (43 of1954) read with West Bengal Special Marriage Rules, 2010 shall be done by electronic mode. All Registering officers are ex-officio marriage registrars of their jurisdiction.

The Hindu Marriage Act applies to any person who is a Hindu by religion in any of its forms or developments, including Virashaiba, Lingayat or a follower of the Brahmo Prarthana or Arya Samaj. It also applies to any person who is a Buddhist, Jaina or Sikh by religion .

A marriage may be solemnized between any two Hindus if the following conditions are fulfilled .

a) Neither party has a spouse living at the time of the marriage
b) Neither party is incapable of giving valid consent to it in consequence of unsoundness of mind
c) The bridegroom has completed the age of 21 years and the bride the age of 18 years at the time of marriage
d) The parties are not within the degrees of prohibited relationship unless the custom or usage governing each of them permits of a marriage between the two
e) The parties are not sapindas of each other unless the custom or usage governing each of them permits of a marriage between the two

Proof of marriage (invitation card, joint photograph and an affidavit from the priest orlocal panchayat bodies),age, residence, passport size photo of bride and bridegroom etc. are required.

For solemnization of the marriages under the SpecialMarriage Act, 1954, either the bridegroom or the bride attaining the age of 21years or 18 years may apply before the Marriage Officer in whose jurisdiction either of them resides. After one month and within three months of submissionof such application, both the bridegroom and the bride along with three witnessess shall have to appear before the Marriage Officer. If no objection is filed by anybody against the solemnization between the said two parties, the Special Marriage Officer will solemnize the marriage between the said bride groom and bride. The Marriage Officer after administering an oath will declare them as husband and wife.

This directorate also processes the appointments and other formalities for Muslim Marriage Registrar and Kazi through the respective District Registrar.
